1. APPLICATION OF TERMS

These terms apply to any person or entity (‘you/your’) accessing (‘our/the website’).

(‘we/our/us’).

By accessing and using our website you agree to be bound by these terms. We may amend these terms and conditions from time to time.

These terms are governed by the laws of the State of Queensland, Australia.

 

 

2. COLLECTION AND USE OF PERSONAL INFORMATION

You may need to register to use our website. When you register you will provide us with personal information such as your name and email address. We will handle all personal information we collect in accordance with our privacy policy, available at https://wildblooms.com.au/pages/privacy-policy and the applicable law.

When you register your account, we will provide you with a username and password. You are responsible for keeping this username and password secure and are responsible for all use and activity carried out under this username.

We require our trade/wholesale clientele to register an account with us in order to obtain any discount they may be eligible for. To apply for a trade account, you will need to complete a data collection form and provide the following information to us: ABN/ACN, name, email, company name, website or social media link, business type, shipping address.

We may otherwise collect personal information about you in order to provide our services and for other purposes as detailed in our privacy policy and required or permitted under applicable law. This may include disclosing your information to third parties that help us deliver our services, such as information technology suppliers, communication suppliers, finance providers and our business partners.

We will handle all personal information we collect in accordance with our privacy policy and the applicable law. Our privacy policy explains:

  • how we store and use, and how you may access and correct your personal information;
  • how you can lodge a complaint regarding the handling of your personal information; and

3. PRODUCTS AND SERVICES

We offer for sale all products listed on our website.

We reserve the right to amend the range and prices of our products at any time.


All products are subject to availability. We will inform you as soon as possible if the product you have ordered is not available.

 

In the event that we determine that there is a technical error in our website, for example in the event that a price for an item is not displayed, we reserve the right to cancel the order and refund any payment amount to you.

 

 

4. PAYMENT METHODS

We accept payment via the following payment methods:

  • Paypal;
  • selected credit cards such as Mastercard, Visa and American Express;
  • Afterpay; and
  • Shop-Pay;

All pricing is in AUD. Prices are subject to change without prior notification and may differ from other sites, stockists or providers.

 

 

5. DELIVERY PHYSICAL DELIVERY

Your order will be delivered in accordance with our shipping policy found at https://wildblooms.com.au/pages/shipping-returns.

 

 

6. COLOUR REPRODUCTION

Wild Blooms makes every effort to display as accurately as possible the colours of our products on our website. However, as computer monitors differ, we cannot guarantee that your monitor’s display of any colour will be an accurate representation of the true colour. In purchasing from Wild Blooms, you agree to accept the small risk that there may be variances in colour as there may be differences in dye batches. We will not accept returns or refunds due to a minor variance in colour.

 

 

7. REFUNDS AND RETURNS

We do not accept returns or provide refunds for change of mind. However, we want our customers to be satisfied with the products they purchase from us which is why we offer a store credit only if:

 

  • The item is faulty;
  • Item has been received damaged;
  • The item is returned to us within 30 days from order date;
  • No cut or tampered stems;
  • You send us an email with description, order date, name and photo of the product within 48 hours of receipt of the delivery.

 

We have a 48 hour return policy for faulty or damaged goods, which means you have 48 hours after receiving your item to request a return. If you have selected the wrong product in your order please contact us as soon as possible for changes to your order prior to shipping as we do not exchange or refund products due to change of mind.


Due to our products being bulky goods sometimes the stems in our artificial products may be bent to fit shipping containers to minimise shipping costs to you. The products are made with a durable wire stem in a plastic or latex coating allowing for bending to suit your use and will return to their original state and accordingly, you agree and acknowledge that bent stems are not considered to be a product fault and these products are not eligible for a return or refund for this reason.

 

If you have provided us the wrong shipping address and your goods are not received you are not eligible to for a refund or return. If you have noticed you provided the wrong address for your order, we may have shipped the goods already but please contact us urgently so we can try redirect the delivery to the correct address. Due to using third party couriers once the order has left our facilities it is out of our hands and beyond our control. Please refer to our shipping policy for further information.

 

Please inspect your order upon receipt and contact us immediately if:

 

  • the item is defective or damaged
  • If you are missing items
  • or receive the wrong item

 

To be eligible for a return for damaged or faulty goods, your item must be in the same condition that you received it and unused. You’ll also need the receipt or proof of purchase (name, order number and date of purchase) which is available from your order confirmation email. In addition to your proof of purchase we require photo evidence of the damaged goods sent to us as part of your request.

 

We will acknowledge your request and a solution will be provided in either:

 

  • Store credit for the damaged or missing goods
  • A replacement of the requested products
  • A refund on the damaged or missing goods

 

If a return is requested by us, we’ll send you a return shipping label, as well as instructions on how and where to send your package. Items sent back to us without first requesting a return will not be accepted.

 

If we have requested a return of your products we will notify you once we’ve received and inspected your return, and will process the agreed solution. If approved for a refund, you’ll be automatically refunded on your original payment method within 10 business days. Please remember it can take some time for your bank or credit card company to process and post the refund too. If more than 15 business days have passed since we’ve approved your return, please contact us at hello@wildblooms.com.au.

 

Certain types of items cannot be returned, like custom products (such as custom orders like bouquets and wedding sets or personalised items). Please get in touch if you have questions or concerns about your specific product. If the product has already been described as having a fault or has any defects disclosed prior to purchase these are not eligible for a refund.

 

Unfortunately, we cannot accept returns on sale items.

 

Our products come with guarantees that cannot be excluded under the Australian consumer law. Nothing in these terms purports to modify or exclude the conditions, warranties, undertakings and legal rights under the Australian Competition and Consumer Act and other local laws. Any and all other warranties or conditions are expressly excluded, including liability for incidental or consequential damages caused by breach of any express or implied warranty or condition.


If your product is faulty or not substantially as described we will take all reasonable steps to either replace, repair or refund the item. To initiate a return, please contact our customer service team.

 

 

8. INTELLECTUAL PROPERTY

Our website and its content including our products, may represent or contain intellectual property owned by us, including trademarks, copyrights and proprietary information.

You may not modify, publish, transmit, participate in the transfer or sale of, create derivative works from, distribute, display, reproduce or perform, or in any way exploit in any format whatsoever any of our intellectual property, in whole or in part, without our prior written consent.

To the extent permitted by law, we have no liability or responsibility to you or any other person for any loss. You acknowledge that you access and use our website at your own risk.

You are responsible for ensuring that your access to and use of the website is not illegal or prohibited, and for your own compliance with applicable local laws.

It is imperative that all Wild Blooms products are used only in the manner for which they are intended, and that care and common sense are exercised when using the products. You agree and acknowledge that all Wild Blooms products are not for human consumption and are not edible and if they are placed on any food items for any purpose including decorative purposes, this is at your risk and we take no responsibility for any damage, loss or injury caused by any ingestion of the products. Any stems or flowers are cut at your own risk and Wild Blooms takes no responsibility for product damage or injury or damage caused by your cutting or trimming of stems. To the extent permitted by law, Tahlia Schembri trading as Wild Blooms does not accept any liability for, and is not responsible for, any damage, loss or injury caused by the use or misuse of our products.

Some packaging used by Wild Blooms may contain plastic, crepe paper or other packaging materials which may pose a choking or suffocation hazard if not used or disposed of appropriately when you receive our products. Wild Blooms does not accept any liability for, and is not responsible for, any damage, loss or injury caused by any packaging materials used to ship our products.

Wild Blooms products (including dried products) may drop fine fragments may pose a choking or suffocation hazard due to the nature of the product and Wild Blooms does not accept any liability for, and is not responsible for, any damage, loss or injury caused.

We are not liable to you or anyone else if interference with or damage to your computer systems occurs in connection with the use of this website or a linked website. You must take your own precautions to ensure that whatever you select from our website is free of viruses or anything else that may interfere with or damage the operations of your computer systems.

Our website may contain links to websites operated by third parties. Such links are provided for convenience and may not remain current or be maintained. Unless expressly stated otherwise, we do not endorse and are not responsible for the content on linked third party websites and have no control over or rights in linked third party websites.

 

 

10. SUSPENSION AND TERMINATION

Without prejudice to any other right or remedy available to us, if we consider that you have breached these terms or we otherwise consider it appropriate, we may immediately and without notice, suspend

Each party submits to the non-exclusive jurisdiction of the courts of the State of Queensland, Australia in relation to any dispute connected with these terms or the website.

For us to waive a right under these terms, the waiver must be in writing.

If any part or provision of these terms is or becomes illegal, unenforceable or invalid, that part or provision is deemed to be modified to the extent required to remedy the illegality, unenforceability or invalidity.
